Terms & Conditions

GymMonk is software that helps gym owners manage members, staff, workout plans, attendance, membership plans and payments, and provides analytics and communication tools. Access to features depends on the subscription plan you choose. GymMonk is not a gym and does not provide fitness, medical or training advice.

You must be at least 18 years old to hold an account. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.

Our plans are:

• Free (₹0/month): get started with core member management for a single center.
• Starter (₹399/month): member management, attendance and payments, and announcements for one center.
• Pro (₹999/month): everything in Starter plus advanced analytics, staff management, custom membership plans, and up to 3 centers.
• Elite (₹2,499/month): everything in Pro plus unlimited centers, priority support and integrations.

• Longer billing terms are offered at a discount, shown before you pay. Exact features per plan are listed in the app under Manage App Subscription.
• Paid plans renew automatically at the end of each billing period unless cancelled before renewal. You authorise us and our payment partner to charge your chosen payment method for the applicable fees.
• All prices are in Indian Rupees (INR). Any applicable taxes are shown at checkout, and the total you confirm is the amount charged.
• Payments are processed securely by our payment partner, Razorpay.
• We may change plan features or prices; we will give reasonable notice, and changes apply from your next billing period.
• Prices that a gym charges its own members are set by that gym and are separate from GymMonk's subscription pricing.
• Refunds and cancellations are governed by our Cancellation & Refund Policy.

GymMonk is a digital service and we do not sell or ship any physical products, so there is no shipping charge and no shipping timeline. When you subscribe to a paid plan, the corresponding features are activated on your account immediately after your payment is confirmed by our payment partner.

You access GymMonk through https://gymmonk.in and our apps using your account credentials. If your plan or features are not activated within a few minutes of a successful payment, contact hello@transcybernetics.com and we will resolve it.

If you use GymMonk to manage members and staff, you are responsible for having a lawful basis to collect and process their information, for the accuracy of the records you enter, and for handling that information in line with applicable law. You act as the data fiduciary for that information and GymMonk acts as your processor.

You agree not to:

• Use the platform for any unlawful, fraudulent or harmful purpose, or to violate any person's rights.
• Upload content or data you do not have the right to use, or that is unlawful, infringing or offensive.
• Attempt to gain unauthorised access to, disrupt, reverse-engineer or overload the platform or its infrastructure.
• Resell or provide the service to third parties except as expressly permitted.

The GymMonk platform, software, design and trademarks are owned by us or our licensors. You retain rights to the data and content you upload; you grant us the limited rights needed to host and process it to provide the service.

GymMonk relies on third parties such as payment processors, hosting and communication providers. Your use of those services may be subject to their terms; we are not responsible for third-party services outside our control.

The service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. We do not warrant that the service will be uninterrupted, error-free or fit for a particular purpose. GymMonk does not provide medical, health or professional fitness advice.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us for the subscription in the three months before the claim.

You may stop using the service and cancel your subscription at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or where required by law. On termination, your right to use the service ends; certain provisions survive.

These Terms are governed by the laws of India. The courts at Dehradun have exclusive jurisdiction over any dispute, subject to applicable law.
