This policy explains what personal data Transcybernetics Private Limited ("GymMonk", "we", "us") collects through the GymMonk platform at https://gymmonk.in and its apps, why we collect it, who we share it with, and the choices and rights you have. We follow India's Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.
1.Who we are
GymMonk is a gym-management platform operated by Transcybernetics Private Limited, Prasad Farm Nakraunda, near Namkeen Factory, Dehradun, Uttarakhand, India. Gym owners use GymMonk to run their gyms — managing members, staff, workout plans, attendance and payments — and to subscribe to GymMonk's software plans. 2.The roles of a gym and of GymMonk
GymMonk is business software. A gym (the owner) decides what member and staff information to collect and enters it into GymMonk; for that information, the gym is the data fiduciary and GymMonk acts as a data processor on the gym's behalf and under its instructions. For a gym owner's own account and subscription, GymMonk is the data fiduciary.
3.The information we collect
Depending on how you use GymMonk, we may collect:
- Account and identity: name, email, phone number, gender and date of birth, and profile photo.
- Business and organisation details (owners): your gym or organisation name, centers/branches, addresses, working hours, and equipment.
- Member and staff records (entered by a gym): a member's or staff member's name, contact details, membership plan, attendance, body measurements a member chooses to add, assigned trainers, and emergency contact.
- Payment information: for subscriptions and, where a gym uses us to collect fees, limited transaction details from our payment partner. We do not store your full card, UPI or bank credentials.
- Usage and technical data: device and app information, log data and IP address, used for security, analytics and abuse prevention.
4.How we use your information
- To provide and operate the platform — member/staff management, workout plans, attendance, insights and announcements.
- To create and manage accounts and to provision the features of your chosen subscription plan.
- To process subscription payments and send receipts, renewal reminders and service notices.
- To provide customer support and respond to your requests.
- To keep the service secure, prevent fraud and abuse, and meet legal obligations.
- To improve the product and develop new features, using aggregated or de-identified data where possible.
5.Who we share it with
We do not sell your personal data. We share it only with:
- Payment processor: Razorpay Software Private Limited, to process subscription and fee payments securely.
- Infrastructure and communication providers: cloud hosting, email/SMS/notification and analytics providers that help us run the service, under confidentiality obligations.
- The relevant gym: a member's or staff member's data is available to the gym that added them, so it can manage the relationship.
- Legal and safety: authorities or advisors where required by law, or to protect our rights, users or the public.
6.Data retention
We keep personal data for as long as your account is active and as needed to provide the service, then for the period required to meet legal, tax and accounting obligations, after which we delete or de-identify it. A gym may delete member/staff records it controls from within the product.
7.Your rights
Subject to applicable law, you can ask to access, correct, update or delete your personal data, withdraw consent, or nominate another person to exercise your rights. To make a request, contact us using the details below. If your data was entered by a gym, we may direct your request to that gym as the data fiduciary.
8.Security
We use reasonable technical and organisational measures — including encryption in transit, access controls and hosting on reputable cloud infrastructure — to protect personal data. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
9.Children
GymMonk is intended for use by gym businesses and adults. Accounts are for users 18 years or older. Where a gym enrols a member who is a minor, the gym is responsible for obtaining any consent required by law.
10.Changes to this policy
We may update this policy from time to time. We will post the updated version here and change the "last updated" date; significant changes may also be notified in the app or by email.
